The Information we collect

We collect information about you when you engage with us either via telephone to our office, through our website, other digital platforms or our partners. 

Some of this information does not identify you personally, but provides us with information about how you use our services and engage with us (we use this information to improve our services and make them more useful to you). 

The information we collect includes some or all of the following:

  1. Your personal details including name, date of birth, address, employment and contact details

  2. Your banking and financial information where you may provide it (including income, expenditure and previous credit history) 

  3. Information about your lifestyle and home ownership

  4. Identifiers assigned to your computer or other devices, including your Internet Protocol (IP) address

  5. Cookie information (see our Cookie Policy)

  6. Details of communications between us (for example emails or call recordings)

  7. Any other information which you may provide to us 

We will also monitor, record, store and use any telephone, email or other electronic communications with you for training purposes so that we can check any instructions given to us and to improve the quality of our customer service. 

Any personal data we collect from you will not be transferred outside the European Economic Area.

How we use this information and the legal basis for processing

We will only process information that is necessary for the purpose for which it has been collected. 

The legal basis of processing will vary depending on the type of service you have requested and we have listed some examples of our processing activities below;

  1. Administering your vehicle quotes and policies (as is necessary for performance of a contract between you and us and/or as is necessary for our legitimate interests);

  2. Carrying out anti-fraud and anti-money laundering checks and verifying your identity (as is necessary for compliance with our legal obligations and/or as is necessary for our legitimate interests);

  3. Assessing financial risks, including by carrying out credit reference checks and credit scoring assessments, (as is necessary for the performance of a contract between you and us and/or as is necessary for our legitimate interests);

  4. Broking your finance agreement and any related services (as is necessary for the performance of a contract between you and us and/or as is necessary for our legitimate interests);

  5. Using your payment details to process payments or refunds relating to a service provided by us (as is necessary for the performance of a contract you and us and/or as is necessary for our legitimate interests);

  6. Sending you information about your end of contract obligations and how to renew your vehicle hire agreement (as is necessary for compliance with our legal obligations);

  7. Communicating with you about your quotes and policies including responding to your enquiries (as is necessary for the performance of a contract between you and us and/or as is necessary for our legitimate interests);

  8. Administering debt recoveries, where you owe us money under a contract or otherwise (as is necessary for the performance of a contract between you and us and/or as is necessary for our legitimate interests);

  9. Undertaking market research and statistical analysis, including analysing your use of our website. This allows us to develop new, or improve existing, products and services (as is necessary for our legitimate interests); and

  10. Fulfilling our obligations owed to a relevant regulator or authority (as is necessary for compliance with our legal obligations and/or as is necessary for our legitimate interests).

Our "legitimate interests" as referred to in this document include our legitimate business purposes and commercial interests in operating our business in a customer-focused, efficient and sustainable manner, in accordance with all applicable legal and regulatory requirements.

Automated Decisions and Profiling

We will never make automated decisions when processing your data nor will we use profiling techniques.

How do we share this information?

We do not sell your information to third parties, but we do work closely with third party suppliers who fulfil business activities for us. 

  • In these situations we will only share the information that is necessary for the third party to perform the processing activity it was provided for, such as;

  • Third party service providers who support the operation of our business, such as IT and marketing suppliers, financial service providers, delivery companies, dealer groups and debt collection agencies (as is necessary for the performance of a contract between you and us and/or as is necessary for our legitimate interests);

  • An example of this is Look After My Car (T/N of Premia Solutions Limited), an approved automotive insurance provider with whom we have partnered. We will pass your contact and vehicle information on to them for the purpose of facilitating membership to their online platform, and for them to contact you to discuss related automotive products and services.   • Third party insurance providers (as is necessary for the performance of a contract between you and us and/or as is necessary for our legitimate).

  • Fraud prevention agencies and associations, (as is necessary for compliance with our legal obligations and/or as is necessary for our legitimate interests);

  • Regulators and law enforcement agencies, including the police, the Financial Conduct Authority or any other relevant authority who may have jurisdiction (as is necessary for compliance with our legal obligations). Some of these third parties may also be considered a data controller in respect of holding your personal data. In these cases, we will provide you with the privacy statements of those parties.

How long do we keep your information for?

We will not hold your personal information for any longer than is necessary. 

If you are a customer or otherwise have a relationship with us we will hold personal information about you for a longer period than if we have obtained your details in connection with a prospective relationship. 

In any event, the retention period will be the statutory retention period unless there is a further legal or regulatory requirement to do so.

How can you manage the information we hold about you?

Under the data protection act you have certain rights in relation to the data we hold about you. 

Under GDPR these rights are extended and listed below;

  • to obtain access to, and copies of, the personal information that we hold about you;

  • to require that we cease processing your personal information if the processing is causing you damage or distress;

  • to require us not to send you marketing communications.

  • to require us to erase your personal information;

  • to require us to restrict or object to our data processing activities;

  • to receive from us the personal information we hold about you which you have provided to us, in a reasonable format specified by you, including for the purpose of you transmitting that personal information to another data controller; and

  • to require us to correct the personal information we hold about you if it is incorrect.

Please note that these rights may be limited by data protection legislation, and we may be entitled to refuse requests where exceptions apply.

Fraud Prevention

If you give us false or inaccurate information and fraud (in any form) is identified, details will be passed to the fraud prevention agencies. 

We and other organisations may also share, access and use this information to prevent fraud and money laundering, for example when:

  • checking details on applications for credit and credit related or other facilities

  • managing credit and credit related accounts or facilities

  • recovering debt

  • checking details on proposals and claims for all types of insurance

  • checking details of job applicants and employees

In addition, law enforcement agencies may access and use this information.

Protecting your privacy

In order to protect the personal data collected from you by GB Vehicle Leasing against accidental or deliberate manipulation, loss, destruction or the access of unauthorised persons, technical and organisational security measures are constantly improved as part of our technological development. 

In addition, our employees, subcontractors and other support staff are obligated to observe confidentiality and data privacy.

Any access to your data that is stored at our company only takes place through an encrypted connection. 

By using the most up-to-date firewall systems, we provide the best possible protection for your data. Wherever possible, we have tried to create a secure and reliable website for our users. 

However, you recognise that your use of the Internet and our website is entirely at your own risk and we have no responsibility or liability for the security of personal information transmitted via the Internet.

All passwords and usernames allocated to you must be kept secret and must not be disclosed to anyone without our prior written authorisation. 

You must not use any false identity in email or other network communications and you must not attempt or participate in the unauthorised entry or viewing of another user’s account or into another system.

You must not use the services and/or network systems or any part thereof for fraudulent activities, or to breach another organisation’s security (cross-network hacking). 

This is an illegal act and prosecution under criminal law may result. 

You must not use any computers, computer equipment, network resources or any services provided by us for any illegal purpose, or for accessing, receiving or transmitting any material deemed illegal, indecent, offensive or otherwise unacceptable under UK law.

We will monitor network traffic from time to time for the purposes of backup and problem solving and in order to ensure that you are not misusing any of the services provided to you.

Breaches

If at any time we become aware that your data has been compromised, or that a breach of our systems and controls has occurred, which has an impact on the security of your data, we will notify the Information Commissioner’s Office, and you, without undue delay.

Subject Access Requests

You have the right to request access to a copy of the personal information that we hold about you. 

This is also known as a ‘Subject Access Request’. 

This information is provided to you free of charge however, we can refuse to respond or charge a ‘reasonable fee’ of £10 inc. VAT when a request is manifestly unfounded, excessive or repetitive.

We will provide this information in a structured, commonly used and machine readable form such as a CSV file. 

This allows you to move, copy or transfer personal data easily from one IT environment to another in a safe and secure way, without hindrance to usability. 

Where possible, we will provide this information via remote access to a secure self-service system, such as our Customer Account area, which would provide you with direct access to your information.

We will response to your request without delay and at the latest, within one month of receipt of your request.

Rectifying or updating personal data

If you believe the personal data we hold about you is inaccurate or incomplete, you have the right to rectification. 

You can let us know about any changes too. 

Where possible, we will also inform any third parties to whom we have disclosed the personal data in question to so they can rectify their records. 

We will typically respond to your request within one month, although this can be extended by two months if your request for rectification is complex, such as a Novation or Transfer of Lease.

Withdrawing Consent

You have the right to withdraw your consent for us to collect, process and store your data at any time.

Please note, by withdrawing consent, GB Vehicle Leasing may be unable to execute the contract that you have entered into with us and will result in termination of our services. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Right to complain

If you have a complaint about any aspect of data protection or if you feel your privacy has been breached by us, we would like to hear from you.

If you are unhappy with the final response you have received from GB Vehicle Leasing, you have the right to complain to the supervisory authority, the Information Commissioner’s Office (ICO) within three months of your last meaningful contact with us.
